Immigration Policy has endured a tumultuous year. With a new leadership came both disruptions to the status quo, and uncertainty about future immigration regulation and legislation. Changes in current policy range from executive orders and new court decisions to changes in administrative norms and executive guidance.
The Administration’s Executive Order “Buy American Hire American” is aimed at strengthening the American economy by focusing on utilizing American workers and products before outsourcing labor and materials. This has catalyzed changes to administrative processes within government agencies. The disruption in immigration processing in the new era is making maintenance of immigration law compliance more challenging than ever before.
Changes are being seen in all industries, and in particular the IT industry. Applications have now been subjected to more scrutiny, and companies who hire foreign students and nationals are finding that the changes impact their ability to secure work visas for their employees. USCIS recently released data that indicated that the number of H-1B approvals has decreased significantly from prior years. Although this does not correspond to an official policy change, it appears that USCIS, consistent with the express goals of the Buy American Hire American Order, has issued more Requests For Evidence after filing. This appears to have had a chilling effect on the number of petitions initially filed, and on employers’ willingness to hire H-1B workers at all.
Despite recent policy changes which make processing more difficult, attracting and retaining critical personnel is the number one challenge for most companies today.
